Terms of Service
1. Operator
The Deskhund service (hereinafter the “Service”) is operated by:
2. Definitions
- Service — the Deskhund software tool that enables automated classification, drafting and sending of replies to customer e-mails using artificial intelligence.
- User — an e-shop operator who has registered an account in the Service.
- Account — a user profile within the Service, accessible after e-mail verification.
- Project — the configuration of a single customer inbox (IMAP / Microsoft 365 mailbox) connected to the Service.
- User Content — e-mails, knowledge base, templates, settings and other data that the User uploads to the Service or that the Service fetches from the User’s mailbox.
3. Subject of the agreement
The Operator grants the User a non-exclusive, non-transferable and revocable right to use the Service to the extent agreed at registration. The agreement between the Operator and the User is concluded upon completion of registration (e-mail verification with a 4-digit code).
4. Registration and account
- Registration is free. The User must provide truthful information.
- The User is responsible for safely storing access credentials (e-mail, 4-digit code).
- The Operator may block or terminate an Account in case of misuse of the Service, breach of these Terms, or suspicion of fraud.
- The User must ensure they are authorised to grant the Service access to the mailbox they connect as a Project.
5. Pricing and payment
The Service is billed on a pay-per-use basis — the User pays only for e-mails actually processed by the AI agent according to the price list published on the website. Registration, onboarding and historical e-mail ingestion are free of charge.
Billing is performed in arrears for each elapsed period. Invoices are due within 14 days.
6. User rights and obligations
- The User must not use the Service to send spam, phishing, fraudulent communications or to engage in any activity contrary to law.
- The User must review AI-drafted replies before they are sent (unless autosend mode is explicitly enabled).
- The User is responsible for the content of their e-mails and for replies sent to customers in their name.
- The User agrees that the content of their e-mails will be transmitted to third-party AI providers (Anthropic, OpenAI, Google) for the purpose of generating reply drafts. See the Privacy Policy for details.
7. Operator rights and obligations
- The Operator undertakes to make reasonable efforts to keep the Service available 24/7, except for planned maintenance and force majeure.
- The Operator stores IMAP passwords and Microsoft Graph tokens in encrypted form (Fernet / AES-128).
- The Operator may modify, extend or temporarily restrict the Service for maintenance at any time.
- The Operator is not responsible for the content of AI drafts or the accuracy of information that the AI includes in replies. The AI is a tool; final responsibility for any reply sent rests with the User.
8. Limitation of liability
The Service is provided “as is”. To the maximum extent permitted by law, the Operator is not liable for:
- indirect damages (lost profit, loss of goodwill, loss of data in other systems),
- incorrect AI-generated replies, where the User had the ability to review them before sending,
- outages of third-party services (Anthropic, OpenAI, Google, Gmail, Microsoft 365, Resend),
- damage caused by misuse of access credentials if the misuse was due to the User’s fault.
The Operator’s total aggregate liability arising in connection with the Service is limited to the amount of fees paid by the User in the past 12 months.
9. Term and termination
The agreement is concluded for an indefinite period. The User may close the Account at any time by sending an e-mail to hello@deskhund.com. The Operator may terminate the agreement with a 30-day notice period; in case of breach of these Terms by the User, with immediate effect.
After termination, the User’s data will be retained for an additional 30 days for restoration purposes, then deleted (except for data the Operator is legally required to retain — e.g. invoices).
10. Final provisions
These Terms are governed by the laws of the Czech Republic, in particular Act No. 89/2012 Coll., the Civil Code. Disputes will be resolved by the competent court in the Czech Republic.
The Operator may unilaterally modify these Terms. The User will be informed of any change by e-mail and through publication of the new version at www.deskhund.com/terms/ at least 14 days before the change takes effect.
If any provision of these Terms is found invalid, the remaining provisions continue in full force.
